Gervase Cullen, Yeoman of Upton, was a Yeoman farmer in Upton. It does not appear that he was married or had any children. His estate was not passed on to immediate family but to the Gill and Baily families. Gervase was a nephew to Theodosia Cullen, meaning that Gervase Cullen who died in 1708 (we have his will as well) was his uncle.


The Will of Gervase Cullen, Yeoman of Upton, Nottinghamshire
Written Jul 21, 1722


In the name of God Amen I Gervas Cullen of Upton near Southwell in the County of Nottingham yeoman Son of Mary Cullen late of Upton widow do make my last Will and Testament in manner and form following Whereas I have surrendered all my Copyhold Lands tenements and hereditaments in Upton aforesaid into the hands of the Lord of the Manor of Southwell to the use and behoofe of my last Will and Testament or other free disposition Therefore I give and devise all those my three acres of arable Land that came to me and my heirs by descent from my father lying in the three feilds of Upton aforesaid To George Gill of Upton and his heirs To and for the uses and upon the trusts hereafter mentioned That is to say Upon Trust to pay the yearly interest of five and twenty pounds for which it is mortgaged and if that money be called for to be paid in then to remortgage the same for the like sum and also in Trust to employ and manage the said three acres of land for the use of Matthew Baily and Mary Baily the two Children of Matthew Baily of Upton aforesaid untill they severally attaine their ages of four and twenty years And then in trust to and for them and their heirs equally to be divided between them to hold as tenants in Common and not as Joynt tenants Item I give and devise to the said George Gill and his heirs All those my two Cowgates upon the like trusts and to and for the like uses of the said two Children of the said Matthew Baily as aforesaid Item I give and devise unto my Aunt Theodosia Cullen of Upton aforesaid All those Six acres of arable land lying in the severall feilds of Upton aforesaid which I lately purchased of her two daughters and their husbands to her for and during the term of her naturall life And after her decease then I give and devise the same to John Cullen son of the said Theodosia his heirs and assignes Charged and Chargeable with the payment of fifteen pounds apeice to Mary and Elizabeth Leeson daughters of John Leeson of Upton aforesaid to be paid within two years next after the death of the said Theodosia their Executors or Administrators although the said Mary and Elizabeth be then dead and in default of payment it shall and may be lawfull for them their Executors admrs or assignes to enter into the said six acres of Land and hold the same till payment be made Item I farther Charge the said six acres of arable Land with the payment of five pounds apeice to my Aunt Theodosias three daughters to be paid within a year after her death with power to enter for non payment And Lastly I make the said Theodosia Cullen the sole Executrix of this my last Will and Testament and give her all my Goods Cattle Chattles and personall estate and all the corn and hay now growing on any part of the premisses Witness my hand and seal the one and twentieth day of July Anno Dni 1722. Ger: Cullen. Sealed and signed and declared to be the last Will and Testamt of the said Gervas Cullen in the presence of us who did in his presence sett our hands as witnesses Theophilus Gilbert Thomas Moore George Gill.

The will does not contain a lot of informati0n and Gervase's holdings were not all that great. However, the information that is there is useful in that it supports the accounts we have of Gervase & Theodosia Cullen's family. Knowing that this Gervase likely did NOT have any immediate family is also useful should anyone suspect him as a candidate for a Gervase Cullen in their own family.
